Social Security and Maintenance

The court must consider the economic circumstances of the parties when making an award of maintenance. The judge is supposed to look at all of the circumstances at the time of the hearing. Social Security benefits that are being received at the time of the divorce trial may be considered when making a maintenance award. Future Social Security benefits, or the prospect of future awards, however, usually are not considered by the court.1
